Expunge Felony Record

Expungement of criminal records are available for both felony or misdemeanor convictions. But the type of relief that is available varies, depending upon both the criminal charges on the felony record and the sentence that was handed down.

Misdemeanor convictions are expunged in line with your state's particular Penal Code Section. In any misdemeanor case, where probation is granted and successfully completed, and where the probationer is not currently facing charges, an expungement is available.

If probation is granted in a felony case, your state's Penal Code will be in control of the felony record expungement, just as it does in a misdemeanor case . A grant of probation will still involve jail time, and, in the case of a felony conviction, often does. A judge has the the right to order formal or informal (also called "summary") probation, and impose a few terms and conditions, including up to one year in county jail.

When the term of probation has expired in time, or been terminated early after a motion by the defense, and if other requirements are met, there is relief available in the form of felony record expungement.

When the guilty plea or verdict has been set aside, and a judgment of not guilty is calculated, a judgment of not guilty is entered, and the complaint of information is thrown out in the case of felony record expungement.
