Clean Record

The law allows you to clean your criminal conviction record by taking back your plea and having the case dismissed, under most cases. The law is somewhat complex in certain areas, but cleaning of a record is something that SHOULD be done by anyone with even a minor history of arrest or conviction. Contrary to popular belief, records are not cleaned automatically with the passing of time, but require the filing of a Petition in Court.

A successful petition may result in:

  • Expunging an adult criminal conviction by a withdrawal of plea and dismissal of the case;
  • Deeming an arrest a "detention only";
  • Cleaning and destroying a juvenile record;
  • A finding of "Factual Innocence";
  • The reduction of a conviction from felony to misdemeanor;
  • The granting of a Certificate of Rehabilitation.

To clean a criminal record it may take from two months to almost a year depending upon the Court and the severity of the case. The fees are reasonable, and include research, filing fees, the drafting of the Petition, and any Attorney in Court showings.

Law enforcement agencies, the legal system and the department of motor vehicles keep DUI records. These groups are also afforded immediate access to DUI records. In the criminal system, DUI records remain on a person's record for ever. The length of time that DUI records remain on department of motor vehicle records varies depending on the state where you reside. When a person is convicted of a DUI the criminal legal system and the department of motor vehicles report and collect DUI records.

There are other offenses relating to a DUI incident that can also be considered criminal and are such are reported in DUI records. Refusing to submit to an alcohol test as requested by a law enforcement official is considered illegal, is punishable in a DUI case, and can be included in DUI records.

Motorists get better insurance rates if they have a clean driving record and aren't involved in any accidents on the roadways, most DUI expungement lawyers say. "There are no studies that I know of on the correlation between a driver's use of child safety restraints in automobiles and auto accidents, but one might conclude that those who takes steps to protect their children and other passengers in their cars are, indeed, safety conscious and are more likely to have good driving records than those who speed along the highways without wearing seatbelts."

Other entities also have the right to access DUI records for years after the DUI incident. Insurance companies can access DUI records. This harms a DUI records holder because insurance premiums can be significantly increased with DUI records or an insurance company can refuse to cover you. Employers, colleges, military organizations and professions with licensing requirements can access DUI expungement records as well. This can make obtaining employment or other endeavors very difficult for people with DUI records.
